01. Introduction
These Contractor Terms apply to any person or business that creates a contractor account, applies to join ER24, submits contractor profile information, seeks approval, views service opportunities, purchases or uses lead access, contacts customers through ER24, or otherwise uses contractor features.
These Contractor Terms are in addition to the ER24 Terms of Service, Privacy Policy, and Refund / Lead Credit Policy. If you do not agree, do not apply as a contractor or use contractor features.
02. Independent Contractor Status
Contractors are independent businesses or independent providers. Contractors are not employees, agents, representatives, partners, franchisees, or joint venturers of ER24 or FOR-DEVS LLC.
ER24 does not control how contractors perform services, set final service prices, manage contractor employees, supply contractor tools, guarantee contractor work, or guarantee contractor income.
Contractors are solely responsible for their own business operations, workers, taxes, vehicles, tools, equipment, licenses, permits, registrations, insurance, safety practices, legal compliance, customer communications, service quality, and service results.
03. Contractor Account and Approval
To access contractor features, you may need to create an account, verify your phone number, complete profile information, provide service categories and service areas, upload documents, and submit an approval request.
ER24 may review information such as:
- Name and contact information.
- Phone verification status.
- Service categories.
- Service cities or coverage areas.
- Business information.
- Driver license information, expiration date, and upload.
- Vehicle registration information, expiration date, and upload.
- Auto insurance information, expiration date, and upload.
- General liability insurance information, expiration date, and upload.
- Service-specific license, permit, registration, insurance, vehicle, equipment, or eligibility information.
- Availability and account status.
- Prior platform activity, support history, or other information relevant to trust and safety.
Submitting an application does not guarantee approval. ER24 may approve, deny, limit, suspend, or remove contractor access at its discretion when appropriate for compliance, trust, safety, fraud prevention, operational, or business reasons.
04. Service Categories and Service-Specific Approval
ER24 may allow contractors to apply for different service categories. Some services may be active for customers immediately, while others may be available only where qualified, approved, and legally eligible contractors are available.
Active public launch services may include:
- Jump Start.
- Flat Tire / Tire Change.
- Out of Gas / Fuel Delivery.
Near-term or gated service categories may include:
- Lockout / locksmith-related roadside assistance.
- Towing.
- Winching.
Later expansion categories may include plumbing, electrical, HVAC, general repair, glass, pest control, and other services.
Selecting a service category in your profile does not automatically authorize you to receive or unlock requests for that category. ER24 may require service-specific approval before enabling a category for your account.
For lockout / locksmith-related work, towing, winching, or other regulated or higher-risk services, ER24 may require additional review, license verification, business verification, insurance review, vehicle review, equipment review, service-area review, or other documentation before activation.
05. Licenses, Insurance, Vehicles, and Compliance
Contractors are responsible for knowing and following all laws, rules, regulations, licensing requirements, permit requirements, insurance requirements, vehicle requirements, equipment requirements, safety requirements, and local requirements that apply to the services they offer.
Contractors must not offer, accept, unlock, or perform any service unless they are legally qualified and properly equipped to perform that service.
Contractors must keep required documents current. Expired, missing, false, incomplete, or unverifiable documents may block approval, block lead access, limit service categories, or result in suspension or removal.
For lockout / locksmith-related services, contractors are responsible for determining whether a locksmith license, business license, employee registration, background check, fingerprinting, examination, permit, or other legal authorization is required before offering or performing the service.
For towing or winching, contractors are responsible for all applicable vehicle, insurance, registration, authorization, storage, pricing, safety, and local or municipal requirements that apply to the work.
ER24's review of documents does not guarantee that a contractor is legally compliant. Contractors remain responsible for their own compliance.
06. Lead Access and Customer Information
Approved contractors may be able to view limited service request information. Before lead access is completed, ER24 may redact customer name, phone number, email address, and full service address.
After completed lead access, ER24 may reveal customer name, phone number, email address, full service address, and map-related information so the contractor can contact the customer and coordinate service.
Customer information may be used only for the specific service request for which it was provided. Contractors must not sell, share, scrape, store unnecessarily, reuse, market to, harass, spam, or otherwise misuse customer information.
Unlocking a lead does not guarantee that the customer will answer, hire the contractor, accept a price, continue with the request, or complete a service.
07. Payments, Wallets, and Lead Credits
ER24 may charge contractors for lead access. The lead access price is the posted price shown at the time of unlock or purchase.
ER24 may support wallet balances, account credits, promotional credits, or third-party payment processing. ER24 may change pricing, wallet credit rules, promotional credit rules, or payment methods from time to time.
Lead access purchases are generally final once customer contact information is revealed, subject to the Refund / Lead Credit Policy.
Unless ER24 expressly states otherwise, payment for the actual roadside service is coordinated directly between the contractor and customer. Contractors are responsible for communicating final service price, scope, payment method, and service terms directly to the customer.
08. Customer Communication and Service Standards
Contractors must communicate professionally, truthfully, and respectfully with customers.
Contractors must not claim to be employees, agents, dispatchers, official representatives, or guaranteed providers of ER24. Contractors must not imply that ER24 guarantees their service, price, arrival time, approval, licensing status, insurance status, or work quality.
Contractors are responsible for complying with laws and rules that apply to calls, texts, emails, customer communications, and marketing. Contractors must not use customer contact information for unrelated marketing or future contact unless they have an independent lawful basis to do so.
Contractors should clearly communicate pricing, timing, service scope, limitations, safety issues, and any inability to perform the service.
09. Prohibited Contractor Conduct
Contractors may not:
- Provide false, misleading, outdated, or incomplete information.
- Use fake documents, expired documents, or documents belonging to another person or business.
- Unlock leads for services they are not qualified, licensed, insured, equipped, or legally allowed to perform.
- Misuse, resell, scrape, share, or store customer information unnecessarily.
- Harass, threaten, spam, discriminate against, or abuse customers, contractors, or ER24 personnel.
- Circumvent ER24 lead access, payment, approval, wallet, safety, or platform rules.
- Submit fraudulent lead credit requests.
- Manipulate customer requests, pricing, reviews, accounts, or service categories.
- Interfere with ER24 systems or access data without authorization.
- Use ER24 for unlawful, unsafe, deceptive, or abusive activity.
10. Suspension, Denial, or Removal
ER24 may deny approval, limit access, suspend access, remove a contractor, disable a service category, block lead access, or close an account when ER24 determines that doing so is appropriate for trust, safety, fraud prevention, legal compliance, operational, or business reasons.
Reasons may include false information, missing or expired documents, suspected fraud, customer complaints, unsafe conduct, misuse of customer information, service-specific compliance concerns, chargeback abuse, policy violations, or failure to maintain eligibility.
ER24 may act without advance notice when needed to protect customers, contractors, ER24, the public, platform integrity, or legal compliance.
11. Changes to These Contractor Terms
ER24 may update these Contractor Terms from time to time. When ER24 updates the terms, ER24 will change the Last Updated date.
Continued use of contractor features after updated Contractor Terms are posted means you accept the updated Contractor Terms.
