These Terms explain the rules for using ER24, a platform that helps connect customers requesting roadside assistance with independent local contractors.

01. Introduction

These Terms of Service govern your use of ER24 / Emergency Repair24 websites, pages, forms, accounts, service request flows, contractor application flows, contractor tools, lead access tools, and related services operated by FOR-DEVS LLC.

By using ER24, creating an account, submitting a service request, applying as a contractor, purchasing lead access, or accessing customer request information, you agree to these Terms and any other policies that apply to your use of the platform.

If you do not agree to these Terms, do not use ER24.


02. ER24 Platform Role

ER24 is a platform that helps connect customers seeking roadside assistance with independent local contractors. ER24 may help create, route, display, or manage service requests and may allow approved contractors to purchase or use lead access to contact customers.

ER24 is not an emergency service provider. ER24 does not provide police, fire, ambulance, medical, public safety, or life-safety services. If you are in danger or need emergency assistance, call 911 or the appropriate emergency service.

ER24 does not guarantee that a contractor will be available, respond, accept a request, arrive by any specific time, complete a service, offer a specific price, or provide a specific result.


03. Accounts and Eligibility

You may need an account to submit service requests, apply as a contractor, verify your phone number, access contractor tools, or purchase lead access.

You must be at least 18 years old to use ER24. By using ER24, you represent that you are at least 18 and have legal authority to agree to these Terms.

You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the security of your account, password, email, phone number, and devices.

You may not create an account using false information, impersonate another person or business, use another person's account, or use ER24 for unlawful, unsafe, fraudulent, abusive, or misleading purposes.

ER24 may require phone verification, email verification, identity-related information, contractor approval, policy acceptance, or other review steps before allowing certain actions.


04. Customer Service Requests

Customers may use ER24 to submit roadside assistance requests. Active public launch services may include jump start, flat tire / tire change, and out of gas / fuel delivery.

Additional roadside services, including lockout / locksmith-related roadside assistance, towing, and winching, may be available only in select areas where qualified, approved, and legally eligible contractors are available and ER24 has enabled those services.

Later expansion categories, such as plumbing, electrical, HVAC, general repair, glass, and pest control, are not part of the public launch service set unless ER24 expressly enables them.

When you submit a request, you agree that the information you provide is accurate and that ER24 may share request details with relevant contractors. Request details may include service type, description, urgency, general location, photos, and other information needed to evaluate the request.

Before a contractor completes lead access, ER24 may redact customer contact details and exact location. After lead access is completed, ER24 may reveal customer name, phone number, email address, full service address, and map-related information to the contractor so the contractor can contact the customer and coordinate service.

Submitting a request does not guarantee that a contractor will respond, accept, arrive, perform work, or offer a particular price.


05. Contractors and Independent Providers

Contractors who use ER24 are independent providers. Contractors are not employees, agents, representatives, partners, franchisees, or joint venturers of ER24 or FOR-DEVS LLC.

Contractors are responsible for their own business operations, licenses, permits, registrations, insurance, vehicles, tools, equipment, taxes, workers, safety practices, legal compliance, service quality, customer communications, prices, and performance.

ER24 may review contractor information, require documents, approve or deny contractor access, limit service categories, and suspend or remove access at any time when ER24 determines that doing so is appropriate for safety, trust, compliance, operational, or business reasons.

Some services may require service-specific approval before a contractor can receive or access related requests. This may include lockout / locksmith-related service, towing, winching, and other regulated or higher-risk services.


06. Service Availability and Pricing

ER24 does not guarantee that any service is available in every location or at every time. Service availability may depend on customer location, contractor coverage, contractor approval status, service category, contractor availability, legal eligibility, and other operational factors.

Final service price is confirmed directly between the customer and the contractor unless ER24 expressly states otherwise. ER24 does not guarantee final pricing, estimates, quotes, discounts, or service outcomes.

Customers are responsible for deciding whether to hire or continue with a contractor after contact is made. Contractors are responsible for communicating prices, scope, limitations, arrival timing, and service details directly to the customer.


07. Lead Access, Payments, Wallets, and Credits

ER24 may allow approved contractors to purchase or use lead access for customer requests. Lead access may reveal customer contact information and full service location.

The lead access price is the posted price shown at the time of unlock or purchase. ER24 may change lead access prices, wallet credit rules, or promotional credit rules from time to time.

ER24 may support wallet balances, account credits, promotional credits, or third-party payment processing for contractor lead access. If a third-party payment processor is used, that processor may process payment data under its own terms and privacy notice.

Lead access purchases are generally final once customer contact information is revealed, subject to the Refund / Lead Credit Policy.

For the current launch model, payment for the actual roadside service is generally coordinated directly between the customer and contractor unless ER24 expressly states otherwise.


08. Communications and Notifications

ER24 may contact users by email, in-app notification, phone verification message, text message, or other available channel for account, verification, service request, contractor, support, safety, payment, wallet, lead access, policy, or operational reasons.

Message frequency may vary. Message and data rates may apply. Where supported, users may be able to reply STOP to opt out of certain text messages or HELP for help.

ER24 does not claim to operate a marketing SMS program as part of the current launch model. If ER24 later offers marketing text messages, ER24 should use a separate consent process where required by law.


09. Prohibited Conduct

You may not use ER24 to:

  • Submit false, fake, fraudulent, misleading, or abusive requests.
  • Impersonate another person or business.
  • Misuse customer or contractor information.
  • Harass, threaten, spam, abuse, or discriminate against another user.
  • Circumvent ER24 lead access, payment, approval, safety, or account rules.
  • Scrape, harvest, resell, or misuse leads or contact information.
  • Access or attempt to access systems, accounts, or data without authorization.
  • Upload malicious code or interfere with platform operation.
  • Use ER24 for unlawful, unsafe, or deceptive activity.
  • Misrepresent your license, insurance, approval status, service area, availability, or qualifications.

10. Disclaimers and Limitation of Liability

ER24 is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ER24 disclaims warranties of availability, reliability, accuracy, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

ER24 does not guarantee contractor availability, response time, arrival time, pricing, service quality, legal compliance by contractors, completion of service, safety outcome, or customer satisfaction.

To the maximum extent permitted by law, FOR-DEVS LLC and ER24 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, service failures, contractor conduct, customer conduct, roadside service outcomes, or disputes between customers and contractors.

Some jurisdictions do not allow certain disclaimers or limitations, so some parts of this section may not apply to you.


11. Suspension, Removal, and Termination

ER24 may suspend, limit, remove, or terminate access to accounts, requests, contractor tools, lead access, wallet features, or platform features when ER24 determines that doing so is appropriate for safety, trust, fraud prevention, legal compliance, operational, or business reasons.

ER24 may also remove content, requests, accounts, or contractor access that violate these Terms or other ER24 policies.


12. Changes to These Terms

ER24 may update these Terms from time to time. When ER24 updates the Terms, ER24 will change the Last Updated date.

Continued use of ER24 after updated Terms are posted means you accept the updated Terms.
